Upon written confirmation of cancellation, Theta Technical will transfer data associated to your service(s) to a CD and mail it to you, upon request. This does not include the proprietary code associated to your service(s), unless otherwise agreed upon, in writing. This will incur a $35 dollar transfer fee, per applicable service. If transfer of service(s) is not requested within thirty (30) days, or is declined, your service(s) may be deleted from servers. As well, the service(s) will not allow FTP capabilities.

Furthermore, host payment plan(s) will be cancelled and any outstanding fees will become due upon cancellation, if applicable.

Telephone and/or VoIP requests for termination of service(s) will not be honored until and unless confirmed in writing.

Development and/or addition schedules/plans may be subject to change depending on implementation needs, client feedback, or developer advisement. Development deviation will be discussed with the Client prior to substantial deviation, unless communication with the Client cannot be established within a reasonable time frame. If communication cannot be established, then Theta Technical may halt, alter, or end development.

Any source code created for your service(s) may not be transferred to another service without written acknowledgement from Theta Technical.

All Theta Technical services may be used for lawful purposes only. You agree to indemnify and hold Theta Technical harmless from any claims resulting from your use of our service that damages you or any other party.

The Client retains the copyright to data, files and graphic logos provided by the Client, and grants Theta Technical the rights to publish and use such material. The Client must obtain permission and rights to use any information or files that are copyrighted by a third party. The Client is further responsible for granting Theta Technical permission and rights for use of the same and agrees to indemnify and hold harmless Theta Technical from any and all claims resulting from the Client's negligence or inability to obtain proper copyright permissions. An acceptance and/or payment of service(s) shall be regarded as a guarantee by the Client to Theta Technical that all such permissions and authorities have been obtained. Evidence of permissions and authorities may be requested. Failure to adequately and legally obtain assets in a timely fashion may prompt termination of service(s).

Theta Technical cannot accept responsibility for any alterations caused by a third party occurring to the Client's service(s) once installed or enabled. Such alterations include, but are not limited to additions, modifications, or deletions.

If applicable, payment is required for service providers, and are non-refundable once paid to the host service.

When applicable, domain registration costs are incurred yearly. You do not have to purchase/renew your domain through Theta Technical, though this is highly recommended to insure compatibility.

Payment is non-refundable for completed work.

Partial refunds may be available at the discretion of Theta Technical for planned work that has not yet been completed upon receiving written confirmation of cancellation at least five (5) days in advance from completion. Proof of payment must be provided to adequately calculate what portions, if any, should be refunded.

Any outstanding fees are due upon Client termination.

If development and/or the enabling of service has already begun (such as creating a design concept), then any down payment is considered non-refundable. Theta Technical may elect, at its sole discretion, to offer a partial refund.
